End User License Agreement (EULA)

1. Agreement Overview

This End User License Agreement ("Agreement" or "EULA") is a legal agreement between you ("User," "You," or "Your") and Scribble Chain ("Company," "We," "Us," or "Our") regarding your use of the Scribble Chain mobile application ("App" or "Application") available for iOS and Android devices.

This Agreement governs your acquisition and use of our App directly from us or indirectly through an authorized reseller or distributor (a "Reseller").

2. License Grant

2.1 Limited License

Subject to the terms of this Agreement, we grant you a revocable, non-exclusive, non-transferable, limited license to:

• Download, install, and use the App on your personal mobile devices
• Access and use the App's features and functionality as intended
• Create, share, and collaborate on artwork within the App
• Connect with friends and other users through the App's social features

2.2 License Restrictions

You may NOT:

• License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the App
• Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the App
• Remove, alter or obscure any proprietary notice (including copyright and trademark notices) of the Company or its affiliates
• Use the App for any revenue generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended
• Make the App available over a network or other environment permitting access or use by multiple devices or users at the same time
• Use the App to create a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the App
• Use the App to send automated queries to any website or to send any unsolicited commercial e-mail
• Use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing or distribution of any applications, accessories or devices for use with the App

4.1 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring your account information is accurate and up-to-date

4.2 Acceptable Use

When using the App, you agree to:

• Use the App only for lawful purposes and in accordance with this Agreement
• Respect other users and maintain a positive community environment
• Not create, share, or distribute content that is offensive, harmful, or inappropriate
• Not attempt to gain unauthorized access to other users' accounts or data
• Not use the App to harass, abuse, or harm other users
• Comply with all applicable laws and regulations

5. Intellectual Property Rights

5.1 Our Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Scribble Chain and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5.2 Your Content

You retain ownership of the artwork and content you create using the App. However, by using the App, you grant us:

• A non-exclusive, worldwide, royalty-free license to store, display, and transmit your content as necessary to provide the App's services
• The right to use your content for promotional purposes (with your consent)
• The right to remove content that violates this Agreement or our community guidelines

5.3 Third-Party Content

The App may contain content provided by third parties. We do not control, endorse, or assume responsibility for any third-party content. You acknowledge that we are not liable for any third-party content and that your use of such content is at your own risk.

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information in connection with the App is governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the App, you consent to the collection and use of your information as outlined in our Privacy Policy.

7. Updates and Modifications

7.1 App Updates

We may provide updates, patches, and new versions of the App from time to time. These updates may:

• Add new features or functionality
• Fix bugs or security vulnerabilities
• Improve performance and user experience
• Modify or remove existing features

7.2 Agreement Modifications

We reserve the right to modify this Agreement at any time. When we make changes:

• We will post the updated Agreement in the App and on our website
• We will update the "Last Updated" date
• For material changes, we will provide notice through the App or email
• Your continued use of the App after changes constitutes acceptance of the new terms

8. Disclaimers and Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SCRIBBLE CHAIN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

9. Termination

9.1 Termination by You

You may terminate this Agreement at any time by:

• Deleting the App from your device
• Discontinuing use of the App
• Closing your account through the App settings

9.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice, if:

• You breach any provision of this Agreement
• You violate our community guidelines or acceptable use policies
• We are required to do so by law
• We discontinue the App or cease operations

9.3 Effect of Termination

Upon termination:

• Your license to use the App will immediately cease
• You must delete the App from your devices
• We may delete your account and associated data
• Provisions that should survive termination will remain in effect

10. Governing Law and Dispute Resolution

10.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.

10.2 Dispute Resolution

Any disputes arising from this Agreement shall be resolved through:

1. Informal Resolution: First, contact us to attempt to resolve the dispute informally
2. Mediation: If informal resolution fails, disputes may be submitted to mediation
3. Arbitration: Binding arbitration as a final resort, conducted under applicable arbitration rules

11. Miscellaneous

11.1 Entire Agreement

This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and us regarding the App and supersedes all prior agreements and understandings.

11.2 Severability

If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Agreement will otherwise remain in full force and effect.

11.3 Assignment

You may not assign or transfer this Agreement or your rights hereunder, in whole or in part, without our prior written consent. We may assign this Agreement at any time without notice.

11.4 No Waiver

Our failure to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.
